Effective Date – March 22, 2026
The Home Renovation (“The Home Renovation”, “we”, or “us”) helps connect individuals and businesses with independent contractors who may assist with home and building renovations, remodeling services, and other commercial and residential contractor work (the “Services”).
The following Terms of Service (“TOS”) govern your access to or use of our Services, regardless of whether you interact with us through our website (https://thehomerenovation.ca)
REPRESENTATIVES
If you are using our Services as a representative (a “Representative”) acting on behalf of a business, company, or other legal entity (in such event, for the purposes of these TOS, “you” and “your” refer to that business, company, or legal entity), then:
You accept these TOS and are responsible for any act or omission of employees, contractors, or third-party agents using the Services on your behalf.
You represent and warrant that the Representative has authority to bind the entity to these TOS.
You covenant that you have the right, power, and authority to enter into these TOS and perform obligations under them.
NATURE OF SERVICES (IMPORTANT)
The Home Renovation does NOT perform contractor work.
Our Services consist of:
Connecting users with independent contractors
Facilitating introductions
Coordinating service inquiries
Providing referral assistance
Contractor work, including renovations, remodeling, and construction services (“Contractor Work”), is performed solely by independent contractors.
All contractors referred through The Home Renovation are independent businesses and are NOT employees, agents, partners, joint venturers, or representatives of The Home Renovation.
INDEPENDENT CONTRACTOR DISCLAIMER (VERY IMPORTANT)
You acknowledge and agree that:
Contractors are independent entities
Contractors operate independently of The Home Renovation
Contractors are solely responsible for:
Their work
Their employees
Their subcontractors
Their insurance
Their licenses
Their warranties
Their pricing
Their services
The Home Renovation does not control, supervise, or direct Contractor Work.
Any contract entered into for Contractor Work is solely between you and the Contractor, and The Home Renovation is not a party to that agreement.
REFERRAL RELATIONSHIPS
You acknowledge that:
The Home Renovation may maintain commercial relationships with independent contractors.
The Home Renovation may receive referral fees from contractors.
These referral relationships do not create partnerships, employment relationships, or agency relationships.
Although The Home Renovation may attempt to refer contractors believed to be qualified, we do not guarantee the performance, quality, safety, or outcome of any Contractor Work.
NO WARRANTY REGARDING CONTRACTOR WORK
You expressly understand and agree that:
Any decision to hire a contractor is at your own risk.
The Home Renovation makes no warranties, express or implied, regarding:
Quality of work
Timelines
Contractor availability
Project completion
Suitability of contractors
Safety of services
This includes, but is not limited to:
Project delays
Construction defects
Property damage
Health or safety risks
LIMITATION OF LIABILITY (CRITICAL)
To the fullest extent permitted by applicable law:
The Home Renovation shall not be liable for:
Any damages resulting from Contractor Work
Any disputes between users and contractors
Any indirect, incidental, consequential, special, or punitive damages
Loss of profits
Loss of property
Business interruptions
If a court determines that The Home Renovation is liable (notwithstanding these provisions), the maximum total liability shall not exceed $100 CAD.
INDEMNIFICATION
You agree to indemnify and hold harmless The Home Renovation, its affiliates, and each of their respective:
Directors
Officers
Employees
Representatives
Contractors
(collectively, the “Indemnified Parties”)
from any and all claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:
Your hiring of any contractor
Contractor Work
Contractor negligence
Contractor misconduct
Property damage
Personal injury
Failure of contractors to perform work
This obligation survives termination of your relationship with contractors or use of the Services.
USER RESPONSIBILITIES
By using the Services, you agree to:
Provide accurate and truthful information
Use the Site lawfully
Independently verify contractor credentials
Review contractor agreements carefully
Maintain responsibility for agreements entered into with contractors
You agree not to misuse the Site or Services.
COMMUNICATIONS
By submitting information through our contact form, you consent to:
Being contacted regarding your service request
Receiving responses related to your inquiry
Being connected with contractors relevant to your request
You may request to stop communications by contacting us through the contact form available on the Site.
TERMINATION
We reserve the right to suspend or terminate access to the Services at any time if:
You violate these Terms
You misuse the Services
We determine termination is necessary to protect our operations or users
GOVERNING LAW
These Terms of Service shall be governed by and interpreted in accordance with the laws of:
The Province of Ontario, Canada,
and the applicable federal laws of Canada.
JURISDICTION
You irrevocably agree that:
Any disputes, claims, or proceedings arising from these Terms or use of the Services shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
LANGUAGE
The parties agree that these Terms and all related documents shall be drafted in English.
